These terms apply to the use of the AmazingBrainz® Home website and purchases made through it. Please read them together with our Privacy Policy and the information displayed for your chosen programme or toolkit.

Accounts and website use
Accounts must be created and managed by adults aged 18 or older. Please provide accurate information, keep your login details secure and contact us if you suspect unauthorised access.
You may not use the website unlawfully, interfere with its operation or attempt to access another customer’s account.
Programme materials may be used only within the scope of the licence attached to your purchase.
Programmes and access
Your access starts on successful payment and continues for the course duration plus an additional seven (7) days). The applicable dates and access conditions will be displayed before payment and confirmed with your purchase.
Internet access and a compatible device are required to use the online programme. The website will identify any additional technical requirements before purchase.
Optional toolkits
Toolkits are optional and are charged in addition to the programme-only price unless expressly included in the selected offer.
A full toolkit contains the items listed for that toolkit. A top-up toolkit is intended to work alongside reusable resources from the immediately preceding age group. Top-ups have fixed contents and are not personalised to previous purchases.
Please review the contents and required reusable resources before ordering. Household items or consumables not listed as included must be supplied separately.
Prices, payment and orders
Prices are displayed in South African rand. Applicable taxes and delivery charges will be shown before you confirm your order.
Payments are processed through Payfast. Your order becomes binding on successful payment for the programme.
You will have an opportunity to review your order and correct errors before submitting it. If we cannot fulfil an order, we will contact you and provide the cancellation or refund options required by law.
Delivery
We deliver physical resources nationwide.
Orders are normally prepared within 1 working days after payment confirmation, followed by approximately 2 working days for courier delivery.
Delivery costs are included in the pricing. Any regional differences or separate deliveries will be explained before purchase.
Cancellations, returns and refunds
Your rights under the Consumer Protection Act and the Electronic Communications and Transactions Act are not excluded by these terms.
Where the Electronic Communications and Transactions Act’s cooling-off provisions apply, you may cancel an eligible purchase without giving a reason within seven days of receiving goods or concluding a services agreement. Statutory exceptions apply. Refunds under this provision are due within 30 days of cancellation, and only the direct cost of returning goods may be charged.
Where the Consumer Protection Act applies, goods that fail to meet its quality and safety requirements may be returned within six months of delivery for the repair, replacement or refund remedy available under that Act.

Returns, Cancellations and Refunds Policy
At AmazingBrainz Home, we want you to be happy with your purchase. If, for any reason, you are not satisfied with your purchase, we are happy to assist with a return in accordance with the terms below.
1. Cancellation Period
You may request cancellation of your purchase within 5 working days of successful payment.
Successful payment provides immediate access to the AmazingBrainz Home online portal and marks the start of the 5-working-day cancellation period.
To request a cancellation, please contact our Support Team at info@amazingbrainz.com within the applicable cancellation period.
This voluntary cancellation policy does not limit or replace any rights you may have under applicable South African consumer protection legislation.
2. Returning the Physical Resource Material
Following receipt of a cancellation request, AmazingBrainz Home will arrange for the physical resource material to be collected from the delivery address provided with your original shipping details.
The resource material should be returned in its original packaging and in its original condition, including all components and materials supplied with the product.
AmazingBrainz Home will provide the applicable collection arrangements and any necessary instructions following receipt of the cancellation request.
3. Refund
Once the returned package has been received and inspected, AmazingBrainz Home will process the applicable refund.
The refund will be for the amount paid for the product, less the applicable return/collection shipping cost.
The refund will normally be made to the original payment method. Once processed by AmazingBrainz Home, the time taken for the refund to reflect in the customer’s account may depend on the relevant payment provider or financial institution.
4. Online Portal Access
Because access to the AmazingBrainz Home online portal is provided immediately following successful payment, portal access will be terminated when a cancellation/refund request is received and processed.
Once access has been terminated, the customer may no longer access the online portal or use the associated online resources.
5. Products Returned in Unsatisfactory Condition
Where the returned physical resource material is damaged, incomplete, materially used, or is not returned in its original packaging and condition, AmazingBrainz Home reserves the right to assess the condition of the returned material before determining the applicable refund, subject always to the customer’s rights under applicable South African consumer protection legislation.
6. Statutory Consumer Rights
Nothing in this policy is intended to exclude, restrict or waive any rights or remedies that a customer may have under the Consumer Protection Act 68 of 2008 or any other applicable South African legislation.
Where a return, replacement or refund is required by law because a product is defective, unsafe, unsuitable for its intended purpose, or otherwise does not comply with applicable consumer protection requirements, those statutory rights will apply independently of this voluntary returns policy.

AmazingBrainz® Home provides educational activities and guidance. It does not replace individual medical advice, diagnosis or therapy, and does not guarantee a particular developmental outcome.
An adult must supervise activities and check that materials and activities are suitable for the individual child. Follow the programme instructions and product safety warnings.
Nothing in this section removes our legal responsibilities for product safety or consumer protection.
Intellectual property
Website and programme content is owned by AmazingBrainz Home (Pt) Ltd or used under licence.
Except where permitted by your purchase licence or by law, you may not reproduce, distribute, resell or publish programme materials without the rights holder’s permission.
Questions, disputes and changes
Please direct questions or complaints to info@amazingbrainz.com. You retain the right to approach an applicable regulator, ombud or court.
These terms are governed by South African law. Updated terms will be dated and published on the website. Changes will not retrospectively remove rights attached to an existing purchase.
